SUMMARY OF INSURANCE COVER
You do not take out an individual insurance policy. Henriksson Storage UK Ltd. is the policyholder under the insurance contract with the insurer, and by paying the applicable fee, your belongings are included in the company’s insurance arrangement in accordance with the terms of the licence agreement. You have no independent or direct rights against the insurer.
This insurance arrangement applies only if, in the licence agreement for the storage unit (the “Licence Agreement”), you have requested that items stored in the unit be included in the company’s insurance contract and you have paid the applicable fee for such inclusion. The licence for the storage unit and your use of it are governed by the terms of the Licence Agreement. You should carefully review clause 6 of the general terms and conditions of the Licence Agreement.
Under the Licence Agreement, all items stored must be insured for their full replacement value (on a new-for-old basis), and the insurance must be maintained on an ongoing basis. Please note that regardless of whether you request that the items you store be included within the company’s insurance arrangement, the company’s liability for actual physical loss of or damage to the items you store is limited by the terms of the Licence Agreement, which forms part of the agreement between you and us.
DEFINITIONS
Your Broker: Xact European Solutions ApS
Administrator: Reason Global Insurance Brokers Limited
MAXIMUM LIMIT
In the event of loss or damage, the maximum amount that may be claimed from our insurer shall be limited to the value you have declared for the items you store, as stated in the Licence Agreement or otherwise notified to us in writing. Regardless of the declared value, the amount payable shall in no circumstances exceed EUR 25,000, unless otherwise expressly confirmed by us in writing.
INSURED RISKS
The insurance cover is limited to claims relating to actual physical loss of or damage to the items you store caused by fire, lightning, explosion, earthquake, storm, flood, burst and/or leaking pipes, ingress of water or other liquids, aircraft or falling objects from aircraft, insects or pests (where caused by external circumstances), theft involving forcible entry to or exit from the building or unit, riot, strike, civil commotion, malicious damage, or impact by vehicles or rolling stock. No other claims are covered under this insurance arrangement.
UNDER-DECLARATION OF VALUE
The value you declare must correspond to the full replacement value of the items you store. If you fail to declare the full replacement value in the Licence Agreement or otherwise notify us in writing, and the items are lost or damaged, our insurer will only indemnify us for the proportion of the loss that the declared value represents in relation to the total replacement value of the stored items. As a result, the amount payable to you will be reduced accordingly.
CLAIMS SETTLEMENT BASIS
Claims shall be settled by replacement, repair and/or compensation at the discretion of our insurer. In the event of total loss or destruction of items (excluding household textiles, clothing and documents), the settlement amount shall correspond to the cost of replacement with a new item, provided that the replacement item is substantially the same as, and not superior to, the original.
Household textiles and clothing
Where a claim relates to loss of or damage to household textiles or clothing, our insurer shall take into account age, quality, wear and tear, and the market value of equivalent items lost or damaged.
Documents
Where a claim relates to loss of or damage to documents, the settlement basis shall be the reasonable cost of reprinting and/or re-issuance and/or reconstruction, including, where applicable, reasonable investigation or research costs required to obtain essential information.
PAIRS AND SETS
Where an item forms part of a pair or a set, the insurer shall only pay compensation for those items that have been lost or damaged. No compensation shall be paid for undamaged items forming part of the same pair or set.
DEDUCTIBLES UNDER THE INSURANCE POLICY
The deductible applicable under the policy is EUR 200 per loss.
For water damage, the deductible is EUR 300 per loss.
CLAIMS NOTIFICATION
Where circumstances arise that may give rise to a claim subject to the deductible under the insurance, you must notify us in writing of such circumstances and request that we submit a claim in respect of the relevant items. All circumstances that may result in a claim must be reported to us as soon as the loss or damage is discovered, or when items are removed from the unit, whichever occurs first. We may then notify our insurer. Failure to notify the insurer promptly may affect the amount payable. Please note that we are not obliged to pay you any amount in excess of what our insurer pays to us in connection with a claim.
Where a claim has been made and we receive payment from our insurer in respect of that claim, we are entitled to require that your rights be assigned to us, and you are obliged to execute such assignment as part of the claims settlement process.
